Sex Offender Registry

The New York State Sex Offender Registration Act requires the Division of Criminal Justice Services (DCJS) to maintain a Sex Offender Registry. The Registry contains information about registered sex offenders classified according to their risk of reoffending:

• Level 1: Low risk
• Level 2: Moderate risk
• Level 3: High risk

Higher Education Reporting Requirements

Registered sex offenders in New York State are required to notify the Registry of any institution of higher education where they are, or expect to be, enrolled, attending or employed, whether for compensation or not. They must also report whether they reside or expect to reside in a facility operated by the institution.

Changes in an individual's status at an institution of higher education must also be reported to the Registry no later than 10 days after the change.

New York State Sex Offender Registration Laws

The following New York State Correction Law provisions address sex offender registration requirements related to institutions of higher education.

Correction Law §168-b

Correction Law §168-b requires the New York State Division of Criminal Justice Services (DCJS) to include information regarding an individual's association with an institution of higher education in the Sex Offender Registry.

Correction Law §168-c

Correction Law §168-c includes requirements related to reporting an individual's address and association with an institution of higher education. These requirements include:

1. The appropriate correctional or hospital facility must require a registered sex offender to provide DCJS with their proposed address upon release, any institution of higher education where they expect to be enrolled, attending or employed, and whether they expect to reside in a facility owned by the institution.
2. A probation officer must require a supervised registered sex offender to notify DCJS of changes in address or changes in enrollment, attendance, employment or residence at an institution of higher education while under supervision.

Correction Law §168-d

Correction Law §168-d requires the court to obtain the name and address of any institution of higher education where the registered sex offender expects to be employed, enrolled or attending, and whether the individual expects to reside in a facility owned or operated by that institution.

Correction Law §168-e

Correction Law §168-e requires a registered sex offender released from a correctional facility to provide the name and address of any institution of higher education where the individual expects to be employed, enrolled or attending, and whether the individual expects to reside in a facility owned or operated by that institution.

Correction Law §168-j

Correction Law §168-j(4) and (5) establish notification procedures when a registered sex offender has indicated to DCJS that they will be enrolled, attending or employed at an institution of higher education. DCJS will notify each law enforcement agency having jurisdiction.
